Terms of Service

Please read these Terms of Service ("Terms") carefully before using BrandVoice-AI ("BrandVoice-AI," "we," "our," or "the Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account, connecting your social media pages, or otherwise using BrandVoice-AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These Terms apply to all users, visitors, and others who access or use the Service.

2. Description of the Service

BrandVoice-AI is a platform that helps users manage, moderate, and engage with comments on their connected social media accounts. The Service provides tools that may include:

  • Automated or assisted comment analysis and classification
  • AI-assisted generation of reply suggestions
  • Integration with social media platforms using Meta's official APIs
  • Tools for reviewing, approving, or automating moderation actions
  • Options for configuring brand preferences, moderation rules, and voice settings

The specific features and capabilities of the Service may change over time. BrandVoice-AI may add, modify, or remove features at its discretion, and no particular feature or integration is guaranteed to remain available.

3. Eligibility & User Accounts

To use BrandVoice-AI, you must:

  • Be at least 18 years old
  • Create an account with accurate information
  • Maintain the security of your credentials
  • Only connect Facebook Pages or Instagram accounts you own or manage
  • Grant necessary permissions for accessing authorized social media content

You are responsible for all activity that occurs under your account.

4. Third-Party Integrations

BrandVoice-AI works in connection with external platforms and service providers, including but not limited to:

  • Meta (Facebook and Instagram), accessed through their official, authorized APIs
  • AI processing providers
  • Authentication and identity providers

Your use of these third-party platforms is governed by their respective terms, policies, and community standards.

The functionality of BrandVoice-AI depends in part on the availability and performance of these external services. Accordingly:

  • We do not control or guarantee the behavior, policies, or availability of third-party platforms.
  • Changes made by Meta or other providers (such as updates to APIs, permissions, or features) may affect certain capabilities of the Service.
  • BrandVoice-AI may be unable to provide certain features if a third-party integration becomes limited, restricted, or unavailable.

All actions taken on your social media accounts through BrandVoice-AI occur within the permissions you grant and in accordance with Meta's official platform framework.

5. Acceptable Use

You agree not to:

  • Use the Service to manage pages you do not own or administer
  • Violate Meta's Terms, Community Standards, or policies
  • Publish harmful, misleading, or unlawful content
  • Attempt to scrape, copy, reverse-engineer, or extract our models or systems
  • Interfere with or disrupt the Service or related infrastructure
  • Upload malicious content or attempt to compromise system security
  • Use the Service to build or assist a competing product

We may suspend or terminate accounts violating these Terms.

6. AI & Automated Decisions

BrandVoice-AI uses artificial intelligence to classify comments and generate suggested replies.

By using the Service, you understand and agree that:

  • AI-generated output may not always be accurate or complete.
  • Suggested replies and classifications are provided for your review and use at your discretion.
  • When automation is enabled, you authorize BrandVoice-AI to publish content on your behalf based on the settings you configure.
  • You can adjust, disable, or override automation settings at any time.
  • AI-generated output is informational and should not be relied on as professional advice.

BrandVoice-AI provides tools and safeguards, but final control over automation settings and content publication always remains with you.

7. User Responsibility for Published Content

You are solely responsible for all content published on your connected Facebook Pages and Instagram accounts, including:

  • AI-generated replies
  • Automated actions
  • Manual moderation decisions

You must ensure that all published content complies with:

Content Responsibility & Platform Policies

BrandVoice-AI uses Meta's official, approved, and fully authorized APIs. This means the Service operates within Meta's technical and policy framework.

You control what gets published — whether manually or through automation settings you configure. Because you determine your brand guidelines, moderation rules, and automation levels, you remain responsible for ensuring that your published content complies with Meta's Community Standards and other platform policies.

As with any tool that publishes content on your behalf, actions taken by the platforms themselves (such as content restrictions or enforcement decisions) are determined solely by Meta's systems and policies.

8. Content & Data Ownership

Your Content

You retain full ownership of all content you provide or configure within the Service, including:

  • Brand profiles
  • Knowledge documents
  • Moderation rules
  • Uploaded materials
  • Configuration data

You grant BrandVoice-AI a limited, revocable license to process this content solely for the purpose of providing and improving the Service.

Social Media Content

BrandVoice-AI does not claim ownership of any comments, posts, messages, or Page content accessed through Meta's official APIs. This data remains the property of you or the respective platform.

AI-Generated Content

Any replies, messages, or outputs generated by BrandVoice-AI and published or approved by you (manually or through automation settings you configure) become your content. You may use, modify, or delete such content at your discretion.

Data Processing

All data is processed and stored in accordance with our Privacy Policy.

9. Billing, Payments & Refunds

If paid plans or subscriptions are offered:

  • Fees are billed in advance on a recurring basis
  • You authorize BrandVoice-AI to charge your payment method automatically
  • All fees are non-refundable unless required by law
  • Failed payments may result in account suspension
  • Prices and subscription details may change with notice
  • Subscription renewals will continue unless cancelled before the renewal date

Trial periods, if available, may be modified or discontinued at any time.

10. Service Availability & Modifications

BrandVoice-AI is provided on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee:

  • Continuous or uninterrupted service
  • Real-time processing
  • API availability from Meta or other integrations
  • Error-free operation
  • Preservation of any specific feature

We may modify, suspend, or discontinue any part of the Service at any time.

11. Disclaimers

To the maximum extent permitted by law:

  • The Service is provided without warranties of any kind
  • We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement
  • We do not guarantee the accuracy, reliability, or quality of AI-generated content
  • We are not responsible for actions taken by third-party platforms (e.g., Meta API limits, account restrictions)

12. Limitation of Liability

To the fullest extent permitted by law, BrandVoice-AI shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, goodwill, or data
  • Damage to brand reputation from AI-generated content
  • Service interruptions
  • Actions taken by Meta, including restrictions, penalties, or API changes
  • Unauthorized access or alteration of your content
  • Outcomes resulting from your use of the Service, including your settings, configurations, inputs, or automation choices.

Our total liability shall not exceed the amount paid for the Service in the 12 months preceding the claim.

Some jurisdictions do not allow all liability limitations, so some exclusions may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless BrandVoice-AI and its employees, officers, and agents from claims arising out of:

  • Your use of the Service
  • Your published content (manual or AI-generated)
  • Your violation of these Terms
  • Your violation of Meta policies
  • Your violation of any applicable laws

14. Termination

Either party may terminate use of the Service at any time.

By You

Delete your account through the dashboard or contact support.

By Us

We may suspend or terminate your account for:

  • Violations of these Terms
  • Abuse of the Service
  • Non-payment
  • Platform misuse
  • Legal or security reasons

We may also temporarily suspend access for maintenance, security reasons, or to protect system stability.

Upon termination, access to your account will cease, and your data will be deleted according to our Privacy Policy.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding online arbitration or mediation, unless required otherwise by applicable law.

Nothing in this section limits any mandatory consumer protection rights that may apply in your jurisdiction.

16. Changes to Terms

We may update these Terms periodically.

Material updates will be communicated via email or dashboard notice.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
